Terms of Service
Effective Date: July 25, 2025
These Terms of Service (“Terms”) govern your access to and use of the Publifia website, services, applications, APIs and related products (collectively, the “Service”), provided by Publifia (“Publifia”, “we”, “us”, or “our”). By accessing or using the Service, you (“you”, “User”, or “Customer”) agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree, do not use the Service.
1. Definitions
Account — your registered user account on Publifia.
User Content — any content, information, text, images, contact lists, or other material that you upload, submit, or create on the Service.
Campaign — an outbound PR/email outreach action configured and initiated by you using the Service.
Gmail Integration — the Service functionality that allows sending email via the Gmail API on behalf of authenticated users.
Subscription — a paid recurring plan for access to the Service’s paid features.
Stripe — third-party payment processor used for payment collection and billing.
API — any application programming interface provided by Publifia.
Services Fees — amounts you pay to Publifia for use of paid features.
2. Acceptance and Changes to Terms
Acceptance.
By creating an Account, accessing, or using the Service, you accept and agree to these Terms.
Modifications.
We may modify these Terms at any time. We will post the revised Terms on our website and update the “Effective Date.” If you do not agree to the updated Terms, you must stop using the Service. Continued use after the Effective Date of changes constitutes acceptance.
3. Eligibility and Account Registration
Eligibility.
You must be at least 13 years old (or older if required by local law). If you are under 18, you may only use the Service with the involvement of a parent or guardian.
Registration.
To use certain features, you must register and create an Account. You agree to provide accurate, current, and complete information and to keep it updated.
Security.
You are responsible for maintaining the confidentiality of your Account credentials and for all activity under your Account. Notify us immediately of any unauthorized access.
4. Services and Use of the Platform
Service Description.
Publifia is an AI-powered PR automation platform that identifies media contacts and assists users in composing and sending personalized email pitches. The Service provides matching, automated outreach templates, and campaign management.
User Control.
All Campaigns and outbound messages must be explicitly initiated and approved by the user. Publifia will not send messages without your action and consent.
Beta Features.
Some features may be in beta. Beta features are provided “AS IS” and may change or be removed without notice.
5. Gmail Integration; OAuth and API Scopes
Scopes Used.
To provide sending functionality, the Service requests access to https://www.googleapis.com/auth/gmail.send (the “Gmail Scope”). We will only request scopes necessary for the requested functionality.
How It Works.
When you connect a Gmail account, you authorize Publifia via Google OAuth. After you grant permission, Publifia receives an access token (and optionally a refresh token) which is used solely to send emails on your behalf through the Gmail API.
Limited Use.
Publifia does not access or read your inbox, contacts, or email content except as necessary to send messages you authorize. We do not analyze, store, or sell incoming email content.
User Approval & Review.
Every message sent through your Gmail account must be constructed or approved via the Publifia interface. You maintain control over recipients, message content, and send timing.
Token Storage & Security.
Access and refresh tokens are stored encrypted and used only for the purposes described here. Tokens expire per Google’s policies and may be revoked by you at any time via your Google account settings or via the Publifia interface.
Revocation.
If you revoke OAuth access, Publifia will immediately disable Gmail-based features for your account and delete stored tokens as described in our Privacy Policy.
Compliance.
You agree to comply with Google’s API policies and Gmail terms when using Gmail integration via Publifia.
6. User Content
Ownership.
You retain ownership of User Content that you submit.
License to Publifia.
By submitting User Content, you grant Publifia a worldwide, non-exclusive, royalty-free, transferable license to host, reproduce, modify, distribute, and display such content solely to provide and improve the Service.
Responsibility.
You are solely responsible for your User Content and for ensuring it does not violate any laws or third-party rights.
Prohibited Content.
You must not use the Service to upload or transmit content that is illegal, fraudulent, spammy, infringing, defamatory, obscene, harassing, or violates any person’s rights. You must not send unsolicited bulk email or otherwise engage in spamming or abusive behaviors.
Right to Remove.
Publifia reserves the right to remove or refuse content that violates these Terms or is otherwise objectionable.
7. Acceptable Use and Prohibited Conduct
Acceptable Use.
Use the Service lawfully and in good faith in accordance with these Terms.
Prohibited Conduct.
You shall not:
- Use the Service to send spam, malware, or phishing emails;
- Attempt to circumvent security or authentication;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Interfere with others’ use of the Service;
- Use the Service in a way that exceeds the scope of granted permissions (e.g., accessing Gmail content beyond sending messages).
Enforcement.
We may suspend or terminate Accounts that engage in prohibited conduct or otherwise pose a risk to the Service or other users.
8. Payments, Subscriptions, Billing, and Refunds
Billing Provider.
We use Stripe (or another payment processor) to process payments. You agree to Stripe’s terms when you make payments.
Subscription Plans.
Paid features are offered via subscription. Subscriptions renew automatically until canceled. Pricing, features, and billing cycles are displayed at checkout and in your Account settings.
Authorization.
By providing payment information, you authorize Publifia (and our payment processor) to charge your chosen payment method for subscription fees and taxes.
Invoices & Receipts.
Stripe generates invoices and receipts. You may receive invoices email upon charges if enabled.
Failure to Pay.
If payments fail, we may suspend your access until payment is made.
Refunds.
Refund policy is stated at purchase. Unless otherwise stated, subscription payments are non-refundable; however, we may provide refunds or pro-rated credits at our discretion.
Chargebacks.
If you dispute a charge with your bank and the dispute is resolved in our favor, you will remain liable for all fees and costs.
9. Free Trials and Promotional Offers
Free Trial.
If a free trial is offered, the terms (duration, features) are described at signup. You must cancel before the trial ends to avoid billing.
Promos.
Promotional codes and discounts are subject to terms and may be revoked if abused.
10. Third-Party Services and Links
Third-Party Services.
The Service may integrate with third-parties (Google, Stripe, analytics providers, social networks). Your use of third-party services is subject to their terms.
Links.
The Service may link to third-party websites; we are not responsible for their content or practices.
11. Privacy and Data Retention
Privacy Policy.
Our Privacy Policy explains how we collect, use, store, and share personal data. By using the Service, you consent to our collection and use as described in the Privacy Policy.
Data Retention.
We retain only the data necessary to provide the Service:
- Email address, profile info: retained while your Account is active and for a reasonable period thereafter to comply with legal obligations.
- OAuth Tokens: stored encrypted and retained only as long as necessary to provide Gmail sending capabilities; tokens are deleted upon revocation, account deletion, or expiration.
- Campaign Data & Logs: retained for operational reasons (e.g., audit, billing, and user activity history) for up to 30 days by default, unless otherwise stated or required by law.
Deletion Requests.
You may request deletion of your account and data by contacting support. We will verify your request and permanently delete your personal data and tokens within 30 days unless legal obligations require longer retention.
Backups.
Some residual copies may persist in backup systems for a limited period; we will expunge such backups in accordance with our backup retention policy.
Security.
We apply industry-standard security measures (encryption, access controls). However, no system is perfectly secure.
12. Intellectual Property
Publifia IP.
All rights, title, and interest in the Service (including software, content, trademarks, logos) are the sole property of Publifia or its licensors.
User IP.
You retain ownership of your User Content. By granting Publifia a license (Section 6), you do not transfer ownership.
Feedback.
If you provide feedback or suggestions, you grant Publifia a perpetual, worldwide, royalty-free license to use and incorporate such feedback.
13. DMCA and Copyright
DMCA Policy.
If you believe your copyright is infringed, follow our DMCA notice procedures (contact information below). Upon receiving valid notice, we may remove the allegedly infringing content.
Counter-Notices.
If you believe a takedown was mistaken, you may submit a counter-notice as per the DMCA procedures.
14. Disclaimers
No Warranties.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, Publifia DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Guarantee of Results.
We do not guarantee that any Campaign will produce a specific outcome, coverage, or response rate.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED. IN NO EVENT SHALL PUBLIFIA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.
Aggregate Cap.
OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO PUBLIFIA IN THE PRIOR 12 MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
16. Indemnification
You agree to indemnify, defend and hold Publifia and its affiliates harmless from any claim, loss, liability, damages, or expenses arising from your use of the Service, your User Content, or your breach of these Terms.
17. Termination and Suspension
Termination by You.
You may terminate your Account at any time via the Account settings. Upon termination, you may request data deletion.
Termination by Publifia.
We may suspend or terminate Accounts for breach of these Terms or suspected malicious activity. We may retain certain data as required by law.
Effect of Termination.
Termination does not relieve you of outstanding payment obligations. Some provisions (e.g., indemnity, limitations) survive termination.
18. Modification or Discontinuation of Service
Publifia may modify, suspend, or discontinue all or part of the Service at any time. We will provide notice where practicable.
19. Notices
We may provide notices via email, posting on the Service, or other reasonable means. Notices to Publifia should be sent to the contact information below.
20. Governing Law and Dispute Resolution
Governing Law.
These Terms are governed by the laws of [Insert State/Country], without regard to conflict of law principles.
Arbitration.
Except where prohibited, disputes will be resolved by binding arbitration in [Insert County/City, State/Country], or as otherwise agreed.
Small Claims.
You may assert small claims where permitted.
21. Export Controls
You agree to comply with all export control laws and not to export or re-export the Service, software, or technical data without necessary authorizations.
22. Miscellaneous
Entire Agreement.
These Terms, together with the Privacy Policy and any other posted policies, constitute the entire agreement.
Severability.
If any provision is invalid, the remainder will continue in full force.
Waiver.
Our failure to enforce a provision does not constitute a waiver.
Assignment.
You may not assign these Terms without our consent. Publifia may assign these Terms in connection with a merger or sale.

24. Additional Clauses Specific to Gmail & Verification
Google Verification.
Publifia has submitted the required documentation for OAuth verification in connection with the Gmail API. If Google requires additional testing or credentials, we will supply secure test accounts and detailed instructions to verify the consent screen.
Audit & Compliance.
We will cooperate with Google’s compliance requests and implement remediation as required.
User Consent.
Users will be required to explicitly consent to OAuth scopes (e.g., gmail.send) and to a privacy disclosure during setup.
25. Refund and Cancellation Policy
Cancellation.
You may cancel subscriptions at any time through Account settings. Cancellation takes effect at the end of the current billing period.
Refunds.
Refunds are issued at Publifia’s discretion. If you believe you are entitled to a refund, contact support and we will investigate.
26. Definitions of Key Security Practices (Informational)
Encryption.
Tokens and sensitive data are encrypted at rest using industry-standard methods.
Access Controls.
Access to production systems is restricted to authorized personnel and audited.
Incident Response.
We maintain an incident response process to address security events.
